1. Who We Are

1.1 ph365.vip is an online gaming platform operating within the PAGCOR-regulated online gaming framework, serving Filipino players across the Philippines. For the purposes of the Philippine Data Privacy Act of 2012 (RA 10173), ph365.vip acts as the Personal Information Controller (PIC) in respect of the personal data it collects from Players.

1.2 ph365.vip has appointed a Data Protection Officer (DPO) responsible for overseeing compliance with RA 10173 and the implementing rules of the National Privacy Commission. Contact details for the DPO are provided in Section 15 of this Policy.

1.3 This Policy applies to all personal data collected through the ph365.vip website, mobile interface, customer support channels, and any other touchpoint through which you interact with the Platform.

2. Personal Data We Collect

2.1 ph365.vip collects the following categories of personal data:

2.2 ph365.vip does not intentionally collect sensitive personal information as defined under RA 10173 (such as health data, political affiliations, or religious beliefs) unless specifically required by law or with your explicit consent.

3. How We Collect Your Data

3.1 Directly from you — when you register an account, complete KYC verification, make a deposit or withdrawal, contact support, or participate in a promotion on ph365.vip.

3.2 Automatically — through cookies, web beacons, server logs, and similar tracking technologies when you access and use the ph365.vip platform. See Section 7 for details on cookies.

3.3 From third parties — including payment processors (GCash, Maya, BPI, BDO, and other Philippine banks), identity verification service providers, and fraud prevention partners, where necessary to verify your identity or process transactions.

3.4 From regulatory bodies — ph365.vip may receive information from PAGCOR or other Philippine regulatory authorities in connection with its compliance obligations.

4. How We Use Your Personal Data

4.1 ph365.vip uses your personal data for the following purposes:

• Account Management: Creating, maintaining, and securing your ph365.vip account, including password resets and account recovery.
• Identity Verification (KYC): Verifying your identity and age (21+) in compliance with PAGCOR KYC requirements and RA 10173.
• Transaction Processing: Processing PHP deposits and withdrawals via GCash, Maya, and Philippine bank transfers.
• Regulatory Compliance: Meeting ph365.vip's obligations under PAGCOR regulations, anti-money laundering (AML) laws, and other applicable Philippine legislation.
• Fraud Prevention & Security: Detecting, investigating, and preventing fraudulent activity, money laundering, and other prohibited conduct on the Platform.
• Responsible Gaming: Monitoring gameplay patterns to identify potential problem gambling behaviour and administering responsible gaming tools such as deposit limits and self-exclusion.
• Customer Support: Responding to your queries, resolving disputes , and providing technical assistance through ph365.vip's support channels.
• Platform Improvement: Analysing usage data to improve the ph365.vip platform, fix bugs, and develop new features that better serve Filipino players.
• Marketing Communications: Sending you promotional offers, bonus notifications, and platform updates — but only where you have given your consent or where permitted by applicable law. See Section 12 for opt-out options.
• Legal Proceedings: Establishing, exercising, or defending legal claims in connection with your use of ph365.vip.

5. Legal Basis for Processing

5.1 Under the Philippine Data Privacy Act of 2012, ph365.vip processes your personal data on the following legal bases:

• Contractual Necessity: Processing required to perform the contract between you and ph365.vip — including account creation, transaction processing, and customer support.
• Legal Obligation: Processing required to comply with PAGCOR regulations, AML obligations, tax reporting requirements, and other applicable Philippine laws.
• Legitimate Interests: Processing necessary for ph365.vip's legitimate interests in fraud prevention, platform security, and responsible gaming monitoring, where these interests are not overridden by your rights.
• Consent: Processing based on your freely given, specific, and informed consent — primarily for marketing communications and optional personalisation features. You may withdraw consent at any time without affecting the lawfulness of prior processing.

6. Sharing Your Personal Data

6.1 ph365.vip does not sell, rent, or trade your personal data to third parties for their own marketing purposes. We share your data only in the following circumstances:

• Payment Processors: GCash, PayMaya/Maya, BPI, BDO, Metrobank, UnionBank, Landbank, PNB, Security Bank, and other Philippine payment providers — solely to process your deposits and withdrawals in PHP.
• Identity Verification Providers: Third-party KYC and identity verification service providers engaged by ph365.vip to assist with PAGCOR-mandated player verification.
• Regulatory Authorities: PAGCOR, the National Privacy Commission, the Anti-Money Laundering Council (AMLC), and other Philippine government bodies, where required by law or regulatory directive.
• Fraud Prevention Partners: Specialist fraud detection and prevention service providers engaged to protect the integrity of the ph365.vip platform and its players.
• IT & Infrastructure Providers: Cloud hosting, data storage, and cybersecurity service providers who process data on ph365.vip's behalf under strict data processing agreements that require them to maintain confidentiality and security standards consistent with RA 10173.
• Legal Advisers: Philippine legal counsel engaged by ph365.vip in connection with regulatory matters, disputes, or legal proceedings, subject to professional confidentiality obligations.

6.2 All third parties with whom ph365.vip shares personal data are required to handle that data in accordance with RA 10173 and ph365.vip's data protection standards. ph365.vip remains responsible for ensuring that third-party processors provide sufficient guarantees of compliance.

6.3 ph365.vip does not transfer personal data outside the Philippines except where necessary to engage internationally-based service providers, in which case appropriate safeguards — including contractual data protection clauses — are put in place prior to any transfer.

7. Cookies & Tracking Technologies

7.1 ph365.vip uses cookies and similar tracking technologies to operate and improve the Platform. A cookie is a small text file placed on your device when you visit ph365.vip. The following types of cookies are used:

• Strictly Necessary Cookies: Essential for the Platform to function. These include session authentication cookies that keep you logged in to your ph365.vip account. These cannot be disabled without affecting core functionality.
• Performance & Analytics Cookies: Used to collect anonymised data about how Players use ph365.vip — such as which pages are visited most frequently and how long sessions last. This data helps us improve the Platform.
• Functional Cookies: Used to remember your preferences, such as language settings and responsible gaming limits you have set, so you do not need to re-enter them on each visit.
• Security Cookies: Used to detect and prevent fraudulent activity, including bot traffic and account takeover attempts.

7.2 You can manage cookie preferences through your browser settings. Disabling strictly necessary cookies may prevent you from accessing certain features of ph365.vip, including your account. ph365.vip does not use third-party advertising cookies or cross-site tracking cookies.

8. Data Security

8.1 ph365.vip implements industry-standard technical and organisational security measures to protect your personal data against unauthorised access, disclosure, alteration, or destruction. These measures include:

• 256-bit SSL/TLS encryption for all data transmitted between your device and ph365.vip servers.
• Encryption of sensitive data at rest, including KYC documents and financial information.
• Role-based access controls ensuring that only authorised ph365.vip personnel can access personal data, and only to the extent necessary for their role.
• Regular security audits, penetration testing, and vulnerability assessments of the ph365.vip platform and infrastructure.
• Multi-factor authentication (MFA) for ph365.vip staff accessing systems that contain personal data.
• Incident response procedures for detecting, reporting, and managing personal data breaches in accordance with NPC notification requirements.

8.2 While ph365.vip takes all reasonable steps to protect your data, no online platform can guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials and for notifying ph365.vip immediately if you suspect any unauthorised access to your account.

8.3 In the event of a personal data breach that is likely to result in a risk to your rights and freedoms, ph365.vip will notify the National Privacy Commission and affected Players in accordance with the timelines prescribed under RA 10173 and NPC Circular 16-03.

9. Data Retention

9.1 ph365.vip retains personal data only for as long as necessary to fulfil the purposes for which it was collected, or as required by applicable Philippine law. The following general retention periods apply:

• Account and KYC Data: Retained for the duration of your account and for a minimum of five (5) years after account closure, in compliance with PAGCOR record-keeping requirements and AML obligations under Republic Act No. 9160 (Anti-Money Laundering Act).
• Transaction Records: Retained for a minimum of five (5) years from the date of each transaction, as required by Philippine financial regulations.
• Customer Support Records: Retained for three (3) years from the date of the last interaction, or longer if the matter is subject to ongoing legal proceedings.
• Marketing Consent Records: Retained for the duration of your consent and for one (1) year after withdrawal of consent, to demonstrate compliance.
• Technical and Usage Logs: Retained for up to twelve (12) months for security and fraud prevention purposes, after which they are anonymised or deleted.

9.2 When personal data is no longer required, ph365.vip will securely delete or anonymise it in a manner that prevents reconstruction or identification of the data subject.

10. Your Data Rights

10.1 Under the Philippine Data Privacy Act of 2012, you have the following rights in respect of your personal data held by ph365.vip:

• Right to be Informed: The right to know whether ph365.vip holds personal data about you, and to receive clear information about how it is processed — as set out in this Policy.
• Right of Access: The right to request a copy of the personal data ph365.vip holds about you, along with information about how it is used.
• Right to Rectification: The right to request correction of inaccurate or incomplete personal data. You can update most account information directly through your ph365.vip account settings.
• Right to Erasure: The right to request deletion of your personal data where it is no longer necessary for the purposes for which it was collected, subject to ph365.vip's legal retention obligations.
• Right to Object: The right to object to the processing of your personal data for direct marketing purposes or where processing is based on legitimate interests.
• Right to Data Portability: The right to receive your personal data in a structured, commonly used, and machine-readable format, and to transmit it to another controller where technically feasible.
• Right to Withdraw Consent: Where processing is based on your consent, the right to withdraw that consent at any time without affecting the lawfulness of processing carried out prior to withdrawal.
• Right to Lodge a Complaint: The right to lodge a complaint with the National Privacy Commission (NPC) if you believe ph365.vip has processed your personal data in violation of RA 10173.

10.2 To exercise any of the above rights, please contact ph365.vip's Data Protection Officer using the contact details in Section 15. ph365.vip will respond to all verified data rights requests within fifteen (15) business days, in accordance with NPC guidelines. We may request proof of identity before processing your request.

11. Children and Minors

11.1 ph365.vip is strictly intended for persons aged 21 years and older. ph365.vip does not knowingly collect personal data from individuals under the age of 21.

11.2 If ph365.vip becomes aware that personal data has been collected from a person under the age of 21, it will immediately close the relevant account, delete the personal data, and — where applicable — return any deposited funds in accordance with its Terms and Conditions.

11.3 If you believe that a minor has registered an account on ph365.vip, please contact our support team immediately via live chat so that the matter can be investigated and resolved promptly.

12. Marketing Communications

12.1 ph365.vip may send you promotional emails, SMS notifications, and in-platform messages about bonuses, new games, and platform updates where you have given your consent to receive such communications during registration or at a later date.

12.2 You may opt out of marketing communications at any time by:

• Clicking the "unsubscribe" link in any marketing email sent by ph365.vip.
• Updating your communication preferences in your ph365.vip account settings.
• Contacting ph365.vip support via live chat and requesting removal from marketing lists.

12.3 Opting out of marketing communications will not affect transactional communications — ph365.vip will continue to send you account-related notifications such as deposit confirmations, withdrawal updates, and security alerts, as these are necessary for the operation of your account.

12.4 ph365.vip does not share your contact details with third-party marketers. All marketing communications originate from ph365.vip directly.

13. Third-Party Links

13.1 The ph365.vip platform may contain links to third-party websites or services. This Privacy Policy applies solely to ph365.vip and does not cover the privacy practices of any third-party sites. ph365.vip is not responsible for the content or privacy practices of any external websites.

13.2 We encourage you to review the privacy policies of any third-party sites you visit, particularly payment provider platforms such as GCash and Maya, which have their own independent privacy policies governing the data they collect.

14. Changes to This Privacy Policy

14.1 ph365.vip reserves the right to update or amend this Privacy Policy at any time to reflect changes in our data processing practices, applicable Philippine law, or NPC guidance. The date of the most recent revision is displayed at the top of this page.

14.2 Where changes are material — meaning they significantly affect how we process your personal data or your rights as a data subject — ph365.vip will notify registered Players via email or in-platform notification at least seven (7) days before the changes take effect.

14.3 Your continued use of ph365.vip after the effective date of any revised Privacy Policy constitutes your acknowledgment of the changes. If you do not agree with the revised Policy, you may request account closure by contacting ph365.vip support.

15.2 If you are not satisfied with ph365.vip's response to your data privacy concern, you have the right to escalate your complaint to the National Privacy Commission of the Philippines through their official channels.

15.3 ph365.vip is committed to resolving all data privacy concerns promptly and transparently. We aim to acknowledge all DPO inquiries within three (3) business days and to provide a full response within fifteen (15) business days of receiving a verified request.
